This website & platform is owned and operated by Talysha Reeve, Hayley Uden and Joseph Frenkel and is protected by copyright laws.
By accessing and/or using this website and related services (including any/all live CPD events), you agree to these Terms and Conditions (Terms).
You should review Terms carefully and immediately cease using our website & engaging in our published content if you do not agree to these Terms outlined below.
Consumer - any person who purchases and/or consumes products containing educational content on the Pod.Sessions and/or The Progressive Podiatry Project platforms and/or attends live events hosted by Pod.Sessions and/or The Progressive Podiatry Project, its content creators and/or licencees.
1. Protection of Data
The Progressive Podiatry Project will share not share any of your data with third parties for any reason.
2. Intellectual Property
All Intellectual Property Rights on the Platform & associated online social accounts including online & live course materials, and the information shared during live events (seminars, workshops, conferences etc) are and remain the intellectual property of Pod.Sessions, The Progressive Podiatry Project & its content creators, or its licensors, whether adapted, written for or customised for a client or not.
You are not authorised to:
(i) Copy, modify, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the course materials in any way that deviates from the original purpose of the content shared with the Consumer.
(Each purchase is a single-user license, should location monitoring identify suspicious account logins your account may be suspended)
(ii) Record any video or audio tape, relay by videophone or by any other means any online course content or live course/workshop/seminar/conference without express written permission by the owners of Pod.Sessions.
(iii) Use any of the online or live course content in the provision of any other course or training whether instructed/presented by Pod.Sessions & its contributors;
(iv) Alter, adapt, copy, disassemble, merge, modify or translate any part of the online courses, subscriptions &/or live content unless a prior distribution contract has been put in place (in writing) & approved only by Pod.Sessions founders – Talysha Reeve, Hayley Uden and Joseph Frenkel.
In consideration of the payment paid by you, you are granted a non-transferable, single user license to use the course materials or live course content in respect of the relevant purchase made by you for the sole purpose of completing the educational CPD content.
Exception – photographs &/or videos of a Consumer engaging in course content, either live or online, is permissible for the purpose of social media as long as:
- Credit is given to Pod.Sessions, The Progressive Podiatry Project (where relevant).
- The purpose is for the Consumer to share their learning experiences for personal and/or clinical brand advertising.
4. Liability
Pod.Sessions, its content creators & licensees accept no liability, either direct or indirect for any adverse event or response arising from a Consumer utilising the educational information provided, including any Consumer interaction with clients in a private and/or clinical setting.
It is assumed that all Consumers hold appropriate & sufficient registrations and insurances to cover clinical services they provide to clients.
Pod.Sessions, its content creators & licensees accept no liability, either direct or indirect for any adverse event or response arising from engagement in any live educational activities, including conferences, seminars and workshops.
This liability waiver covers all engagement by the Consumer in physical activities that may arise during the course of a live event (conference, seminar and workshop) - including exercise demonstrations, clinical assessments and any other related activities.
5. Payments
Payment is accepted by credit/debit card through Kajabi Payments, a service hosted by Stripe - a safe and secure website payment portal.
Stripe is a certified PCI Service Provider Level 1.
This is the most stringent level of certification available in the payments industry.
Other secure payment methods are integrated into the payment platform, including PayPal, Afterpay, Apple Pay and Google Pay.
Refunds are 100% at the discretion of the Pod.Sessions for any reason not covered by the Australian consumer guarantees outlined here.
6. Cancellation / Attendance Policy
Cancellation Policy
If you are unable to attend a purchased live event, please contact us to discuss the below options.
Should you cancel attending the live event you will be eligible for a refund after a deduction of the following charges.
Cancellation prior to below cut off dates - 5% of workshop fee.
4-2 weeks prior to live event - 10% of workshop fee.
Less than 2 weeks prior to live event - 25% of workshop fee.
Less than 72 hours - 50% of workshop fee.
No show - 100% of workshop fee.
Transfer of your workshop registration may be possible to other events, however, there may be additional charges associated with this.
These will be determined on a case-by-case basis.
Event Cancellation by Organisers
Should the organiser be required to cancel the workshop you will be eligible for a credit for use at a rescheduled date or a refund of 100% of your workshop fee (+/- online course, depending on your preference)
Covid Policy
If you have tested positive for Covid-19, are unwell &/or displaying signs and symptoms of possible Covid-19 infection please contact workshop organisers immediately and refund/credit options will be discussed with you.
Evidence of positive Covid-19 test may be requested.
Rescheduling
Should a Consumer request to reschedule attending a live event and wish to attend the same live event at a different time/location, this may be possible however, a small fee may be payable depending on the amount of notice given, time-frame, and final decision will be at the discretion of Pod.Sessions.
